Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondent to award the petitioner one more mark for the Question No.97 in "B Series" in the TET Examination 2013 and thereby include the petitioner in the eligibility list and give appointment for the petitioner.

ORDER

It is stated by the learned Standing Counsel for the respondent that as against the order of the Writ Court, they have preferred an appeal in W.A(MD) SR.No.62874 of 2021. It is further stated that as against the order passed in the connected writ petition, the respondent had preferred an appeal in W.A.No.167 of https://hcservices.ecourts.gov.in/hcservices/ 1/2

Cont.P.(MD) No.31 of 2020 2020 and the same was allowed by the Hon'ble Principal Bench of this Court.

2.While that being so, it would not be appropriate to have the contempt proceedings pending, particularly, when the order of the Writ Court in the present case has also been appealed by the respondent.

3.Accordingly, this Contempt Petition stands closed. After disposal of the writ appeal, the petitioner is of the view that the disobedience still exist, it is open to him to workout his remedy in accordance with law.
