JUDGMENT

The present Civil Miscellaneous Appeal is filed by the wife being aggrieved by the decree of divorce granted by the Family Court, Madurai in H.M.O.P.No.191 of 2000 filed by the husband.

2. Pending appeal, the matter was referred to mediation and the parties have settled their dispute. The settlement agreement in the presence of the mediator has been drawn on 06.09.2018. In view of the said settlement, a memo has been filed by the appellant stating that the matter is settled out of Court and he is not pressing the Civil Miscellaneous Appeal and the appeal may be dismissed without costs.

3. This Court, after ascertaining from the respective learned counsels and being satisfied that the terms of the settlement have already been effected, has taken note of the memo filed by the appellant. Accordingly, the Civil Miscellaneous Appeal is dismissed as settled out of Court, confirming the dissolution of the marriage as per the judgment and decree passed by the Family Court in H.M.O.P.No.191 of 2000 dated 29.08.2003. There shall be no order as to costs.
