RESPONDENT/COMPLAINANT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify one of the condition to execute two sureties for a sum of Rs.10,000/- subject to the satisfaction of the Learned Sessions Judge, Special Court for POCSO Act Cases, Tirunelveli instead of to execute a own bond for a sum of Rs.10,000/- in CRL OP(MD) No. 23114/2023 DATED 21.12.2023 on the file of this Hon'ble High Court and allow this petition.

Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.C.SUSIKUMAR, Advocate for the petitioner and of MR.P.KOTTAICHAMY, Government Advocate (Criminal Side) on behalf of the Respondent, the court made the following order:- 1/3

Vide order dated 21.12.2023, this Court had enlarged the petitioner on bail on certain conditions. This petition has been filed by the petitioner seeking modification of the condition insofar as it relates to executing a own bond for a sum of Rs.10,000/- subject to the satisfaction of the learned Sessions Judge, Special Court for POCSO Act cases, Tirunelveli.

2. Learned Government Advocate (Crl. side) appearing for the respondent, has no serious objection.

3. In view of the above submission, this Court is of the considered view that the prayer as sought for by the petitioner could be acceded to.

4. Accordingly, the condition insofar as execution of own bond alone is modified and the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum sum to the satisfaction of the learned Sessions Judge, Special Court for POCSO Act cases, Tirunelveli. All other conditions remain unaltered.
