passed by the third respondent addressed to the second respondent so far as Survey No.111, Attrangarai Village, Ramanathapuram Taluk, Ramanathapuram District, is concerned and quash the same and consequentially direct the second respondent to register the documents executed by the petitioner in respect of the properties in Survey Nos.111/1A, 111/1B, 111/1C, 111/2A1, 111/2A2, 111/2B and 111/3A. For Petitioner :

Mr.J.Barathan For Respondents : Mr.A.Baskaran, Addl. Govt. Pleader.

ORDER

The Writ Petition is filed, challenging the communication of the third respondent, dated 05.05.2017, requesting the second respondent to stop registration of transfer of lands pertaining to various survey numbers mentioned in the communication in respect of the villages, namely, Perungulam, Atrangarai and Nagatchi in Ramanathapuram District, on the ground that the lands situated in those survey numbers are proposed to be acquired for extension of I.N.S. Parundu Air Station.

2. When the writ petition is taken up for hearing, this Court is informed by the Additional Government Pleader, who takes notice for

respondents, that the third respondent post is no longer in existence and the same is abolished. The learned Additional Government Pleader, on instructions, received from Revenue Tahsildar, Ramanathapuram, in his proceedings Na.Ka.S1/5393/2024, dated 27.06.2025, submits that extension of Air Force Station and acquisition of land therefor are still in proposal stage.

3. Though the impugned communication issued by the third respondent, which post was abolished as early as 05.05.2017, no acquisition notifications have been issued for the past eight years. In these circumstances, there is no justification in giving effect to the impugned communication of the third respondent, that too even after abolition of the said post. Therefore, the impugned communication of the third respondent is set aside. However, liberty is given to the revenue officials concerned to send a new communication to the second respondent in case concrete steps are taken for issuance of acquisition notification in future.

4. With the above direction, the Writ Petition stands allowed to the extent as indicated above. No costs.
