ORDER : The Court Made the following order :- The petitioner/A3 apprehend arrest at the hands of the respondent police for the offences punishable under Sections 6(4) of Tamil Nadu Scheduled Commodity (RDCS) Order, 1982 and under Section 7(1)(a)(ii) of the Essential Commodities Act, 1955, in Crime No.147 of 2018, seeks anticipatory bail.

2.The case of the prosecution is that one Nagaraj used to collect PDS rice sold in the fair price shop and kept in the residence of one Palaniammal, who also used to collect PDS rice from the cardholders and the respondent police secured 850 kgs of PDS rice from the resident of A1. Hence, the complaint. On the basis of the confession statement, the petitioner is arraigned as A3. 3.Heard the learned counsel appearing for the petitioner. 4.The learned Government Advocate (criminal side) submitted that the investigation is pending.

5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner shall donate 150 kgs of Ponni Rice to Anbagam, Race Course Road, Pudur, Madurai and on such donation, the petitioner is ordered to be released on bail in the https://hcservices.ecourts.gov.in/hcservices/

event of arrest or on his appearance before the learned Judicial Magistrate, Uthamapalayam and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.30 a.m. for a period of two weeks and thereafter, as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
