(1) That the award passed by the Motor Accident Claims Tribunal (Additional District Judge/Fast Track Court No.2),Tirunelveli dated 31.03.2009 made in M.C.O.P.No.411 of 2002 be and hereby is set aside and the matter is remitted back to the Tribunal for fresh consideration.
(2) That the Tribunal do restore the MCOP on its file in the original number and proceed to dispose of the same in accordance with law and in the light of the observations and directions contained in the judgment herein within a period of four months from the date of receipt of a copy of this judgment,
(3) That both the parties are permitted to examine additional witnesses and to mark additional documents and to recall the witnesses already examined.
