DECREE:- This Civil Miscellaneous Appeal having come up Tuesday the Tenth day of August Two Thousand and Twenty one for final hearing, upon perusing the grounds of Appeal, the order of the Tribunal and the material papers to the Appeal and upon hearing the arguments of Mr.T.SELVAKUMARAN, Advocate for the Appellant and of Mr.R.Manimaran, Advocate for the first respondent and of Mr.S.Srinivasa Raghavan, Advocate for the second respondent, this Court while disposing appeal, doth order and decree as follows:-

(1) That the award passed by the Motor Accident Claims Tribunal (Additional District Judge/Fast Track Court No.2),Tirunelveli dated 31.03.2009 made in M.C.O.P.No.561 of 2002 be and hereby is set aside and the matter is remitted back to the Tribunal for fresh consideration.

(2) That the Tribunal do restore the MCOP on its file in the original number and proceed to dispose of the same in accordance with law and in the light of the observations and directions contained in the judgment herein within a period of four months from the date of receipt of a copy of this judgment, https://hcservices.ecourts.gov.in/hcservices/ 1/2
