A.(MD).No.30 of 2021 :- This Criminal Appeal is filed under Section 14 (A)(1) of the Schedule Castes and Tribes Prevention of Atrocities Act 2015 as amended by Act of 2016 to call for the records pertaining to the order passed in Cr.M.P.No.462 of 2020 in Crime No.1712 of 2020 on the file of the Special Court for Trial of Cases under SC/ST (POA) Act, Theni dated 31/12/2020 and to set aside the same as illegal and enlarge the Appellant on bail by allowing the Appeal. Prayer in CRL.M.P.(MD) No.2867 of 2021:- This Criminal Miscellaneous Petiion is filed under Section 439 (1)(b) of Criminal Procedure Code to relax the Condition imposed on her by this Hon'ble Court vide Order dated 03.02.2021 in CRL. A. (MD).No.30 of 2021.

ORDER:- This Criminal Miscellaneous Petiion coming on for orders on this day and upon perusing the earlier order dated 03.02.2021 and the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.K.Sivabalan, Advocate for the Petitioner and of M/s.Bharathi, Government Advocate (Criminal Side) for the 1st and 2nd Respondents, this Court made the following order:

The petitioner filed this petition for relaxing the bail condition imposed by this Court on the petitioner in Crl.A.(MD) No.30 of 2021 dated 03.02.2021.

2. The learned counsel for the petitioner submitted that the petitioner is abiding the condition imposed by this Court without any deviation and the investigation was over and charge sheet filed. https://hcservices.ecourts.gov.in/hcservices/

Hence, he prayed the condition to be relaxed.

3. The learned Government Advocate (criminal side) fairly admitted that the petitioner is complying with the condition regularly.

4.In the above circumstances, the condition already imposed on the petitioner is relaxed and the petitioner is directed to appear before the lower Court as and when required by the Court. Accordingly, this petition is allowed.
