ORDER

This is a petition seeking initiation of contempt proceedings against the Respondent for violation of the order, dated 02.09.2022 passed by this Court in W.P.(MD)No.16423 of 2021.

2. Heard Ms.Oviya, learned counsel for Mr.T.Pon Ramkumar, learned counsel for the Petitioner and Mr.F.Deepak, learned Special Government Pleader, for the Respondents.

3. When the matter was taken up on 20.02.2025, this Court passed the following order:

"2.Mr.F.Deepak, learned Special Government Pleader, submits that the 2nd Respondent/District Educational Officer (Secondary), Tenkasi, has sent proposals dated 20.12.2024 and 30.01.2025 to the 1st Respondent/Chief Educational Officer, Tenkasi, in compliance with the judgment and order passed by this Court dated 02.09.2022 in W.P(MD)Nos.16423 and 17990 of 2021. He further submits that the matter is likely to be finalized shortly and requests this Court to grant two weeks' time to comply with the judgment and order dated 02.09.2022 passed in W.P.(MD) Nos. 16423 and 17990 of 2021.

3. A copy of the proposal has been produced before this Court, and a copy has also been furnished to the learned counsel for the Petitioner.

4. The learned counsel for the Petitioner, after perusing the proposal, raises no objection if the 1st Respondent passes a reasoned and speaking order, taking into account the judgment and orders passed by this Court dated 02.09.2022 in W.P.(MD) Nos. 16423 and 17923 of 2021, as well as the proposal submitted by the 2nd Respondent.

5. Mr.F.Deepak, learned Special Government Pleader, assures that the 1st Respondent will pass a reasoned and speaking order in compliance with the aforementioned judgment and order of this Court.

Considering the arguments advanced by the learned counsel for the Petitioner and the learned Special Government Pleader for the Respondents, and having perused the proposals dated 20.12.2024 and 30.01.2025, and taking note of the assurance given by Mr.F.Deepak, learned Special Government Pleader, that the 1st Respondent will pass a reasoned and speaking order in compliance with the judgment and order passed by this Court dated 02.09.2022 in W.P.(MD) Nos. 16423 and 17990 of 2021, the matter may be posted after two weeks.

7. The learned Special Government Pleader is directed to file a compliance report, annexing the decision taken by the 1st Respondent, on the next date fixed by this Court.

8. Put up this case on 20.03.2025 "For Orders".

9. Let the copy of the order is also given to Mr.F.Deepak, learned Special Government Pleader for its necessary compliance and information to the Respondents.

Today, when the matter is being taken up, Mr.F.Deepak, learned Special Government Pleader for the Respondents, produced an order dated 19.03.2025, passed by the Chief Educational Officer, Tenkasi District / 1st Respondent along with the compliance affidavit and submits that the Respondent has fully complied with the Court's order dated 02.09.2022 in W.P.(MD)No.16423 of 2021. A copy of the said order has been taken on record and furnished to the learned counsel for the Petitioner. Therefore, he prays that the Respondent be discharged from the contempt proceedings.

Ms.Oviya, learned counsel for Mr.T.Pon Ramkumar, learned counsel for the Petitioner submits that she has received the copy of the order dated 19.03.2025 and submits that the direction issued by this Court vide judgment and order dated 02.09.2022 in W.P.(MD)No.16423 of 2021 has been fully complied with. She further states that she has no objection to the Respondents being discharged from the contempt proceedings. 5/8

Considering the submissions made by the learned counsel for the Petitioner and the learned Special Government Pleader for the Respondents, and upon perusal of the order dated 19.03.2025 passed by the Chief Educational Officer, Tenkasi District / 1st Respondent along with compliance affidavit, this Court is satisfied that the Respondents have fully complied with the judgment and order of this Court dated 02.09.2022 passed in W.P.(MD)No.16423 of 2021. In view of the same, this Court deems it appropriate that no useful purpose would be served by keeping the contempt proceedings pending. Therefore, the Respondents are discharged from the contempt proceedings.

7. In view of the above, the Contempt Petition is disposed of. The file shall be consigned to record. There shall be no order as to costs. 20.03.2025 Index:Yes/No Web:Yes/No Speaking/Non Speaking Nsr 6/8
