CMA(MD). No.1078 of 2013 doth order and decree as follows:-
(1) That the award and decree passed by the Motor Accident Claims Tribunal, Principal Subordinate Judge, Madurai in MCOP.No.36 of 2002 dated 28.08.2012 be and hereby confirmed and the Civil Miscellaneous Appeal is dismissed.
(2) That the Appellant / Insurance Company be and hereby is directed to deposit the entire award amount with accrued interests and costs, less the amount already deposited, if any, within a period of six weeks from the date of receipt of a copy of this Judgement.
(3) That on such deposit being made, the first respondent/claimant is permitted to withdraw the entire award amount, with accrued interests and costs, without filing any formal application before the Tribunal.
