Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.ARUN SRIVASTAVA.M, Advocate for the petitioner and of MR.A.THIRUVADI KUMAR, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed to relax the condition imposed on the petitioner in Crl.M.P.(MD).No.8997 of 2023 in Crl.A.(MD).No.471 of 2023 on 16.11.2023.
2. The learned counsel for the petitioner would submit that as per the direction of this Court, the petitioner is complying with the conditions regularly. He further 1/3
submitted that the petitioner is residing at Dindigul and due to his ill health, he is not in a position to travel from Dindigul to Srivilliputhur, to open his shop, which is more than 270 kilometers. Owing the same, he has no sufficient means to meet out his day-today needs and hence, he pleaded for relaxing the condition imposed on him by the Court below.
3.The learned Government Advocate (Criminal Side) would submit that petitioner is complying with the conditions imposed by this Court regularly, but however failed to appear before the concerned Court for four days and hence, the conditions may be modified once in a month.
4. Considering the submissions made on either side, the condition imposed as against the petitioner is modified to the effect that the petitioner shall report before the learned Sessions Judge, Special Court for POCSO Act Cases, Virudhunagar District at Srivilliputhur, on the first working day of every English calender month at 10.30 a.m., until further orders.
