CRIME NO.2 OF 2009 ... RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to suspend the sentence imposed on the petitioner by the judgment dated 28/06/2018 passed in Special Case No.64 of 2011 on the file of the Special Court for the trial of cases under the Prevention of Corruption Act, Madurai and enlarge the petitioner on bail pending disposal of the above criminal appeal and thus render justice. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of MR.A.RAJARAM, Advocate for the petitioner and of MR.K.K.

RAMAKRISHNAN, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- The petitioner herein is held guilty for the offence under Sections 7 and 13(2) r/w 13 (1) (d) of the Prevention of Corruption Act. The trial Court has sentenced the petitioner to undergo two years SI and to pay a fine of Rs.2,000/- in default to undergo three months simple imprisonment to each of the ofeences. On perusing the ground of bail petition earlier, this Court found that there is no material to interfere and to suspend the sentence. Hence, this Court dismissed the petition to suspend the sentence on 31.08.2018. 2.Thereafter, the appellant has surrendered before the trial Court and he was committed to prison on 01.10.2018.

The learned counsel for the petitioner would submit that the petitioner is suffering from cerebral atrophy with chronic ischemic changes. Therefore, he was advised to take rest and periodical medication. https://hcservices.ecourts.gov.

3.Considering the health ground and the medical report, this Court is inclined to grant bail and suspend the sentence pending disposal of the appeal on the following conditions:- (i)The petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for a like sum to the satisfaction of the learned Special Judge for the trial of cases under the Prevention of Corruption Act, Madurai.
