ORDER
This Civil Miscellaneous Appeal has been filed to set-aside the decree and Judgment, 01.12.2006 passed in M.C.O.P No. 390 of 2004 by the learned Motor Accidents Claims Tribunal (III Additional Subordinate Judge), Tiruchirapalli.
2.On a perusal of the records, this Court is of the considered opinion that it is not necessary to interfere with the award amount passed by the learned III Additional Subordinate Judge/Motor Accidents Claims Tribunal, Tiruchirapalli in M.C.O.P.No.390 of 2004 to the tune of Rs.77,000/- with 7.5% @ interest from the date of claim petition till the date of realisation along with Advocate fee of Rs.3,560/-.
3.In view of the same, the award passed by the Tribunal is confirmed and this Civil Miscellaneous Appeal stands dismissed. There is no order as to costs. The claimant is permitted to withdraw the award amount deposited in the Tribunal.
