ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of IPC r/w Section 21(1) of Mines & Minerals (Development and Regulation) Act, 1957, in Crime No.1392 of 2022, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the accused had transported 1⁄2 unit of river sand, without valid permit. Hence, the case..
3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence, as alleged by the prosecution. This is the second petition. Hence, prays to release him on anticipatory bail. https://www.mhc.tn.gov.in/judis 1/2

4. The learned Government Advocate (Crl.Side) submitted that the accused had illegally transported mineral. Though this is the second petition, there is no change in circumstances. Hence, prays to dismiss the petition.
5.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 6.This Court very recently on 08.12.2022 granted permission to withdraw the anticipatory bail petition filed by the petitioner. Subsequently, the petitioner has filed a second petition seeking for anticipatory bail. However, this Court finds no change in circumstances to enlarge the petitioner on anticipatory bail. 7.In view of the above, this Criminal Original Petition stands dismissed.
