R. KALAIMATHI , J., At the instance of the learned counsel for the appellant/Insurance Company, this appeal came up under the caption ''for being mentioned''.
2. Heard the learned counsel for the appellant/Insurance Company and the 1st respondent / Petitioner.
3. The order of pay and recovery passed by the Tribunal has been confirmed by this Court in this appeal.
4. Registry to delete the paragraph Nos.17 to 19 of the Judgment of this Court in C.M.A.(MD).No.1344 of 2013, dated 27.02.2025 and insert the following paragraphs.:
''17.The claimant herein has preferred C.M.A.(MD).No.1479 of 2013 for enhancement of compensation and the said C.M.A., has been partly allowed, enhancing the compensation amount from Rs.1,94,119/- to Rs. 3,03,119.
18. The appellant/Insurance Company is directed to deposit the enhanced compensation amount of Rs.3,03,119/- (less the amount already deposited if any) together with interest at the rate of 7.5% per annum from the date of claim petition till the date of deposit to the credit of M.C.O.P.No. 57 of 2012 on the file of Motor Accident Claims Tribunal / Chief Judicial Magistrate, Tirunelveli, within a period of eight (8) weeks from the date of receipt of a copy of this Judgment.
19. The appellant/Insurance Company shall pay the compensation to the claimant at the first instance and thereafter to recover the same from the owner of the vehicle.
20. On such deposit being made, the claimant/first respondent is permitted to withdraw the award amount along with interest and costs, if any already withdrawn, by filing necessary application before the Tribunal. No costs.''
5. The other portions of the judgment in C.M.A.(MD).No.1344 of 2013, dated 27.02.2025 remains unaltered.
