Respondents/Petitioners Civil Miscellaneous Appeal is filed under Section 173 of Motor Vehicles Act, 1988, against the judgment and decree made in M.C.O.P.No.877 of 2013, dated 17.09.2014 passed by the Motor Accidents Claims Tribunal/Vth Additional District Court, Madurai. DECREE: This Civil Miscellaneous Appeal coming on for hearing on this day upon perusing the grounds of Appeal, the order of the Lower Court, and the material papers relating to this case and upon hearing the arguments of Mr.P.Prabhakaran, Advocate for the Appellant and of Mr.R.Ganesh prabu, Advocate for the respondents and this Court while allowing this Appeal in part with modification doth order and decree as follows: (i)That the compensation awarded by the Tribunal be and is hereby is reduced from Rs.8,13,000/-(Rupees Eight lakhs Thirteen thousand only) to Rs.6,61,000(Rupees Six Lakhs Sixty one thousand only) as modified compensation.

(ii)That the Appellant herein/Transport Corporation be and hereby is directed to pay the award amount of Rs.6,61,000/-(Rupees Six Lakhs and sixty one thousand only) with interest at 7.5% per annum and costs from the date of petition till the date of realisation, within a period of Twelve (12)weeks from the date of receipt of a copy of the order, less the amount already deposited, if any.
