ORDER
The present revision petitions have been filed challenging an order, refusing to condone the delay in setting aside the abatement caused by the death of the sole appellant, to set aside the abatement and to bring on record the legal heirs of the deceased sole appellant in the first appeal.
2. The petitioners have also filed an application seeking a consequential amendment of the cause title to implead the legal heirs of the sole appellant in the first appeal. The said applications have been dismissed by the trial Court. Challenging the same, the present revision petitions have been filed by the appellants in A.S.No.41 of 2002 on the file of the Sub-Court, Trichy. Pending revision, the petition against respondents 2 to 4,6,7 and 10 in the revisions have been dismissed for non payment of batta. The 13th respondent has also not been served. The respondents against whom, the revision has been dismissed are the respondents in the first appeal and the defendants in the suit, in whose favour, the decree has been passed. The unserved respondents are necessary 3/4
parties, steps have not been taken for the past ten years. Hence, nothing survives in these petitions. All these Civil Revision Petitions stand dismissed. No costs. Consequently, connected Civil Miscellaneous Petitions are closed.
