O R D E R

[Order of the Court was made by M.DURAISWAMY, J.] Though the petitioner has filed the above writ petition to issue a writ of certiorarified mandamus to quash the impugned planning permission, dated 18.07.2019, granted by the second respondent and the consequential building plan approval, dated 29.07.2019, granted by the third respondent, to the fourth respondent, and to direct the official respondents to demolish the unauthorized constructions made by the fourth respondent in the "prohibited zone", within the time limit stipulated by this Court, as against the planning permission granted under Section 49 of the Tamil Nadu Town and Country Planning Act, 1971, he has got remedy by way of appeal under Section 79 of the Tamil Nadu Town and Country Planning Act, 1971.

The petitioner has filed the writ petition without exhausting the appeal remedy available to him. In such circumstances, we are not inclined to entertain the writ petition. However, it is open to the petitioner to challenge the planning permission and the building plan approval granted by the respondents 2 and 3 respectively to the fourth respondent, in accordance with law.
