PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the first respondent to revoke the suspension issued by the third respondent by his proceedings in Memo No. 010948/728/Adm/C.1/F.Suspension/2024, dated 03.10.2024 by considering the petitioner representations dated 02.12.2024 and 10.12.2024 and pass appropriate orders on merits and in accordance with law. ORDER

The instant Writ Petition has been filed by an Assistant Executive Engineer working in the Tirunelveli Electricity Distribution Circle, challenging his order of suspension dated 03.10.2024.

2. A perusal of the impugned suspension order reveals that the petitioner has been arrested on 01.10.2024 in a Vigilance and Anti-Corruption Case. Thereafter, the petitioner was placed under deemed suspension on 03.10.2024. The petitioner has given a representation on 02.12.2024 and 10.12.2024 seeking revocation of suspension order.

3. The learned Standing Counsel appearing for the respondents submits that, unless they get the consent from the Vigilance and Anti-Corruption Department, they would not be in a position to consider the request of the petitioner.

Considering the above said facts, the respondents are directed to consider the representation of the petitioner dated 10.12.2024 and pass orders on merits and in accordance with law after getting inputs from the Director of Vigilance and Anti-Corruption Department, within a period of twelve(12) weeks from the date of receipt of a copy of this order. In the mean time, the respondents authorities are directed to disburse the subsistence allowance to the writ petitioner.

5. With the above said observations, this Writ Petition is disposed of . There shall be no order as to costs.
