ORDER

This Criminal Original Petition is filed seeking to direct the Chief Judicial Magistrate, Theni to pass an order clubbing C.C.No.318 of 2020 on the file of the Learned Judicial Magistrate, Uthamapalayam, Theni District along with C.C.No.99 of 2023 on the file of the Judicial Magistrate (FTC Level), Uthamapalayam claiming that both the cases are case and case in counter.

2. Considering the nature of the relief sought for, notice to the 2nd respondent is dispensed with.

3. In view of the above, the learned Trial Court is directed to follow the mandate of Nathi Lal & others Vs. State of U.P & another reported in 1990 Supp Supreme Court Cases 145. It is made clear that 2/4

the same Magistrate shall take up the case and deal with it simultaneously.

4. With the above directions, this Criminal Original Petition stands allowed. Consequently, connected Miscellaneous Petitions are closed.
