DECREE:- This Civil Miscellaneous Appeal having come up for final hearing on this date, upon perusing the grounds of Appeal, the order of the Tribunal and the material papers to the Appeal and upon hearing the arguments of Mr.G.VENUGOPAL, Advocate for the Appellant and MR.C.JAWAHAR RAVEENDRAN, Advocate for the Respondent No.3/ Insurance Company and no Appearance For the Respondents, No.1 & 2 either in person or by an advocate this court while Partly Allowing this Civil Miscellaneous Appeal, doth order and decree as follows:-

(1) that the finding of the Tribunal below Fixing contributory negligence be and here by is set aside and the Civil Miscellaneous Appeal is Partly allowed;

(2) that the (*)Third Respondent/3rd Respondent herein be and hereby is directed to deposit the entire award amount of Rs.1,47,000/- to the credit of the claim petition with interest at the rate 7.5% per annum., within a period of eight weeks from the date of the copy of this judgment;
