: Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to provide the basic amenities like, playground, compound wall, toilet, library, furnitures and other facilities for the safety of the students to the Municipal Middle School, Kalanivasal Karaikudi, Sivagangai District.

O R D E R

*********** [Order of the Court was made by M.M.SUNDRESH, J.] The present Writ Petition, styled as "Public Interest Litigation", has been filed seeking a direction to the respondents to provide basic amenities like, playground, compound wall, toilet, library, furnitures and other facilities to the Municipal Middle School, Kalanivasal Karaikudi, Sivagangai District.

2. The sum and substance of the grievance of the petitioner is that an attempt is being made to lay a compound wall by restricting the available area of 49 cents.

3. In the counter affidavit filed by the second respondent, it has been stated that what has been available is only 26 cents. It has been further stated that it is not correct to state that 200 students are studying in the said school, but, only 85 students are studying. The compound wall has, in fact, been laid only for the purpose of safeguarding the interest of the students.

4. In view of the above, we do not find any merit in this Writ Petition, which is, accordingly, dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
