O R D E R
This Civil Revision Petition is directed against an order passed in I.A.No.1 of 2019 in O.S.No.1690 of 2009 on the file of the Court of Principal District Munsif, Trichy. The said application was filed by the respondents 1 and 2 herein to implead themselves as defendants 3 and 4 in the main suit and the same was allowed by the learned Trial Court. Aggrieved by the same, the petitioners/plaintiffs filed the present Civil Revision Petition.
2. This Court by order dated 10.10.2022 passed the following order:
" This case is/these cases re listed before this Court under the caption for "Notice Section Default Cases".
2. The petitioner(s) is/are granted three weeks time from today to comply with the defects pointed out by the Office, failing which the concerned Civil Revision Petition (s) shall stand automatically dismissed insofar as respondent(s) R1 an 2 against whom batta/steps is/are due."
3. Inspite of the above order, the petitioners failed to take necessary steps. Consequently, the Civil Revision Petition stood dismissed as against the respondents 1 and 2 by virtue of the above order. Even as on date, no such steps are taken either to recall the said order dated 10.10.2022 or otherwise. The fact remains that Civil Revision Petition stood dismissed as against the respondents 1 and 2 who are the contesting respondents. In view of the dismissal of the Civil Revision Petition as against the respondents 1 and 2, the same is equally not maintainable against the 3rd and 4th respondents, who
are formal parties. Hence, the Civil Revision Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 14.03.2024.
