ORDER

This writ petition has been filed for the following relief : "directing the respondents 1 to 5 to cancel the Electricity Service Connection Nos.442, 604, 1260, 850, 65, 1062, 756, 628, 1145, 709, 984, 1029, 374, 505, 506 and 507 pertaining the petitioner's property comprised in old S.No.253/7 in New S.No. 253/7B2A, 253/7B2B, 253/7B1 situated at Manakkattoor Kudagipatti Village, Natham Taluk, Dindigul District within the time stipulated by this Court on the basis of the petitioner representation dated 26.09.2022."

2. The case of the petitioner is that he is the absolute owner of the subject property. While he was residing in the Sri Lankan Refugee Camp at Villupuram, several unknown persons, in collusion with the officials of the 3rd respondent, erroneously obtained electricity service connections

bearing Service Connection Nos.442, 604, 1260, 850, 65, 1062, 756, 628, 1145, 709, 984, 1029, 374, 505, 506 and 507 for his property. These connections were issued without verifying ownership of the property. He would further submit that the Civil Court has already declared the petitioner as an absolute owner vide judgment and decree in O.S.No. 1667 of 1992 and A.S.No.130 of 2005 and the second appeal is now pending before this Court. Pursuant to the same, patta was also issued to the petitioner in Patta Nos.2856 and 614. Seeking cancellation of the aforesaid illegal electricity service connections, the petitioner submitted a detailed representation on 26.09.2022. Since the same was not considered, the petitioner is before this Court.

3. The learned counsel appearing for the 9th respondent would submit that as regards Survey No.253/7B2B, a civil suit had been filed and the same has been decreed in his favour and the appeal filed against the said decree has also been dismissed.

4. Heard the learned counsels on either side.

5. Without going into the merits of the case, this writ petition is disposed of on the following terms :

(i) The 9th respondent shall produce the copies of the decree and judgment passed in his favour.

(ii) The 6th respondent is directed to consider the representation of the petitioner, dated 26.09.2022 and pass orders after affording an opportunity of personal hearing to the petitioners and all other interested parties. While passing orders, the 6th respondent shall take into account the suits referred to above.

(iii) The said exercise shall be completed within a period of one (1) month from the date of receipt of copy of this order.

6. With the above directions, this Writ Petitions stands disposed of. No costs.
