ORDER

[Order of the Court was made by N.ANAND VENKATESH, J.] This petition has been filed seeking suspension of the sentence of imprisonment imposed on the petitioner by the learned District and Sessions Judge, Karur, in S.C.No.26 of 2022, dated 08.10.2025 and to enlarge the petitioner on bail.

2. The case of the prosecution is that on 29.08.2021, at about 2.30 p.m., A1 to A3 had parked their vehicle on the road. The same was questioned by the deceased and he asked the accused persons to move the vehicle, which led to a wordy quarrel. With this motive, A1 to A3 were said to have gone to the place of the deceased at about 9.00 p.m., and there was a wordy quarrel. The deceased was abused with filthy language and A2 and A3 caught hold of the hands of the deceased, while A1 assaulted the deceased with a stick. This led to the demise of the deceased.

3. Based on a complaint, an FIR came to be registered in Crime No.365 of 2021 for the offences under Sections 294(b), 342, 302 and 506(ii) of IPC. There are totally three accused persons in this case and the petitioner has been arrayed as A3. On considering the facts and circumstances of the case and on appreciating the oral and documentary evidence, the Court came to the conclusion that the prosecution has proved the case beyond reasonable doubt. Insofar as the petitioner (A3) is concerned, he was convicted and sentenced as follows: Provision under which Sentence convicted Sec. 120(b) of IPC Life Imprisonment and fine of Rs.10,000/-, in default to undergo four years Simple Imprisonment.

Sec. 294(b) of IPC 15 days Imprisonment.

Section 342 of IPC One year of imprisonment.

Section 302 r/w. 120(b) of IPC Life Imprisonment and fine of Rs.10,000/-, in default to undergo four years Simple Imprisonment.

The above sentences were ordered to run concurrently. 3/7

4. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

On carefully considering the submissions made on either side and the judgment of the trial court, it is seen that the overt act attributed against the petitioner (A3) is that he caught hold of the deceased. The case requires appreciation of the eyewitness account and it will take some more time for this Court to deal with the appeal on merits. The petitioner has been serving the sentence from October 2025 onwards and it is brought to the notice of this Court that there is one previous case against the petitioner.

6. In the light of the above discussion, we are inclined to grant suspension of sentence, suspending the sentence imposed against the petitioner and accordingly, this petition is allowed on the following conditions:

i. The petitioner is directed to be enlarged on bail on executing a bond for Rs.10,000/- (Rupees Ten thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate I, Kulithalai.

ii. The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Trial Court may obtain a copy of their Aadhar card or Bank passbook to ensure their identity.

iii. The petitioner shall appear and sign before the trial Court at 10.30 a.m., on the first working day of every English calender month, till the disposal of the Criminal Appeal. [N.A.V., J.] & [K.K.R.K, J.] 10.04.2026 NCC : Yes / No Index : Yes / No Indu 5/7
