DECREE:- This Civil Miscellaneous Appeal having came up for final hearing on this day, upon perusing the grounds of Appeal, the order of the Tribunal and the material papers to the Appeal and upon hearing the arguments of MR. S.C. RAMACHANDRAN, Advocate for the Appellant, MR. K. GUHAN, Advocate for the 1st and 2nd respondent and there was no appearance for the 3rd respondent, this Court doth order and decree as follows:-

(1) That the award passed by the Motor Accident Claims Tribunal, Sub Court, Uthamapalayam dated 29/09/2009 passed in MCOP NO.104 of 2008, be and hereby is confirmed and the Civil Miscellaneous Appeal is dismissed.

(2) That the Appellant/Insurance Company be and hereby is directed to deposit the entire award amount with accured interest and costs, within a period of 8 weeks from the date of receipt of copy of this order, less the amount already deposited if any;

(3) That on such deposit, the claimants/respondents 1 and 2 be and hereby is permitted to withdraw the award amount by filing necessary application before the Tribunal.
