Prayer: Civil Miscellaneous Appeal filed under Section 173 of Motor Vehicles Act,1988, praying to set aside the order of the Tribunal of the Motor Accidents Claims Tribunal cum Principal Sub Court, Tirunelveli made in M.C.O.P.No.62 of 2013, dated 18.11.2014. DECREE: This Civil Miscellaneous Appeal coming on for hearing on this day, upon perusing the grounds of Appeal, the Judgment and Decree of the Lower Court and the material papers in this appeal and upon hearing the arguments of Mr.C.Jawahar Ravindran, Advocate for the Appellant and of Mr.T.Selvakumaran, Advocate for the 1st respondent and the 2nd respondent has been given up, this Court while dismissing this appeal, doth order and decree as follows:-

1. that the award dated 18.11.2014 passed by the Motor Accidents Claims Tribunal cum Principal Sub Court, Tirunelveli made in M.C.O.P.No.62 of 2013, be and hereby is confirmed and this Civil Miscellaneous Appeal stands dismissed;

2.that the appellant/Insurance Company, be and hereby is directed to deposit the entire compensation amount of Rs.2,92,140/- (Rupees Two Lakh Ninety Two Thousand One Hundred and Forty Only) with interest at 7.5% per annum and costs from the date of petition till the date of realization, within a period of eight weeks from the date of receipt of a copy of this order, less the amount already deposited, if any;

3.that on such deposit, the 1st respondent herein/Claimants be and hereby is entitled to withdraw the same, less the amount already withdrawn by them, if any, by filing proper application before the Tribunal; and https://hcservices.ecourts.gov.in/hcservices/
