For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 67/2018 on the file of the Respondent Police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences under sections 147, 148, 294(b), 324 and 307 of I.P.C., in Crime No.67 of 2018, on the file of the respondent police, seeks anticipatory bail.

3. The petitioner in his petition has claimed that this is the first anticipatory bail petition but this averment is false. The petitioner was the fourth petitioner in Crl.O.P.(MD)No.8973 of 2018 and it suffered dismissal as far as the petitioner was concerned. There are totally 11 accused in this case. While I granted anticipatory bail for four accused, I dismissed for the other accused. The petitioner had also suffered dismissal. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. I had earlier observed that the only course open to the petitioner is to surrender and take regular bail. Therefore, this second petition is not maintainable. That apart, the petitioner has made a false averment that this is a first petition for anticipatory bail. Hence, I am not inclined to grant any relief. The criminal original petition stands dismissed.
