JUDGMENT

Today, when the M.P(MD)No.1 of 2007 is listed, cause list shows that the sole respondent died and steps due. 2.The learned Special Government Pleader produced a letter, dated 15.10.2008 bearing Roc No.A5/7787/2001 addressed to Government Pleader by S.Kathiresan, Tahsildar, Kovilpatti sent a letter to withdraw the Second Appeal No.1046 of 2007 and submitted that the appellant has not taken any steps to bring on record the Legal Representatives of the sole respondent and the appellant is not interested in pursuing the appeal.

3.Recording the said submission, the second appeal is dismissed as abated. No costs.
