DECREE:- This Civil Miscellaneous Appeal come up for hearing on Wednesday the Twenty Third Day of December Two Thousand and Twenty and upon perusing the grounds of Appeal, the order of the Tribunal and the material papers to the Appeal and upon hearing the arguments of Mr.K.Bhaskaran, Advocate for the Appellant and none appeared for the 1 to 4 and 6th respondents and the 5th respondent was dismissed vide order of this court dated 10.04.
1. That the award passed by the Motor Accident Claims Tribunal cum Principal sub Judge, Nagercoil, dated 13.08.2010 made in MCOP No.61 of 2009 be and hereby is set aside and the Civil Miscellaneous Appeal is allowed;

2. That the 6th respondent/the Vehicle owner, who remained exparte before the Tribunal, be and hereby is directed to pay the entire compensation with interest and costs within a period of two months from the date of receipt of a copy of this order.
3. That on such deposit being made, the claimants be and hereby are permitted to withdraw their proportionate share as apportioned by the Tribunal, if the minors have attained majority and if not, the order passed by the Tribunal, if the minors have attained majority and if not, the order passed by the Tribunal has to be complied in respect of minors; and
