The above appeal has been filed by the husband challenging the dismissal of his Divorce Petition in I.D.O.P No.100 of 2008, on the file of the I Additional District Judge, Tirunelveli. 1/3
2. Pending appeal, the learned counsel appearing for the appellant has sent a notice to the client, which has been returned with an endorsement that the "addressee is deceased".
3. In view of the above said fact that one of the spouse has passed away and there was no decree for divorce, this Civil Miscellaneous Appeal is dismissed as abated. No costs.
