ORDER:- This Appeal coming on for orders on this day, upon perusing the Grounds of Appeal and proceedings before the Court of Sessions and upon hearing the arguments of Mr.T.Senthilkumar, Legal Aid Counsel for the Appellant/Accused and of Mrs.S.Bharathi, Government Advocate (Cri. Side) for the respondent, it is ordered as follows:

1. that the Criminal Appeal be and hereby is allowed;

2. that the conviction and sentence imposed on the Appellant in S.C.No.354 of 2008, on 30/06/2009, by the Additional Sessions Judge, Fast Track Court No.2, Madurai, be and hereby is set side;

3. that the appellant/accused be and hereby is acquitted of the charges.

4. that the Superintendent Central Prison, Madurai, be and hereby is directed to release the accused forthwith, if his detention is no longer required in connection with any other case or proceedings.
