O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing the respondent to mutate the Patta No.611 comprised in Survey No.6, Upparpatty Village, Theni Taluk, Theni District in the name of the petitioner.

2. Heard the learned counsel for the parties and perused the materials available on record.

When the matter was taken up for hearing, learned Special Government Pleader appearing on behalf of respondents 1 to 5 submits that the petitioner's appeal is pending before the third respondent / Revenue Divisional Officer and that the same will be considered and disposed of in accordance with law.

In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent to consider and dispose of the petitioner's appeal on merits and in accordance with law and pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order.

5. Such representation shall be considered and disposed of after conducting an inquiry, affording a reasonable opportunity to the petitioner, the respondents 6 and 7 and to all other persons who may be affected by such decision during the course of the inquiry. In the event of any issues pertaining to land disputes, the parties shall approach the competent civil court. No costs.
