PRAYER :- For Anticipatory Bail in Crime No.26 of 2021 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120 (b), 294(b), 406 and 420 of IPC, in Crime No.26 of 2021, seeks anticipatory bail.
2.When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the State would submit that after completing the investigation, the respondent police has filed the final report before the jurisdictional Magistrate and the same was taken on file in C.C.No.1730 of 2022, pending on the file of the learned Judicial Magistrate No.V, Madurai and the learned Magistrate while taking cognizance of the case, ordered for issuance of summons for the appearance of all the accused, including the petitioner herein.

CRL OP(MD). No.302 of 2023 3.Since the learned Magistrate has ordered issuance of summons, the question of granting anticipatory bail does not arise at all. The petitioner is at liberty to appear before the concerned Magistrate and if required, he shall execute a bond as directed by the learned Magistrate.
4.In the result, this Criminal Original Petition is disposed of.
