This petition has been filed to admit the appeal and call for the records in C.A.No.68 of 2008, dated 01.12.2008 on the file of the Additional Sessions Judge / Fast Track Court No.1, Tuticorin, set aside the same and to convict the accused for the offence punishable under Section 138 of the Negotiable Instruments Act.

2. The learned counsel for the appellant submitted that the present appeal has been filed as against the acquittal. Now the respondent / accused died. Therefore, the entire charge abated as against the accused.
