ORDER

This writ petition has been filed seeking for a writ of mandamus, directing the respondent Police to give protection to the life of petitioner, her husband and his family members. 2.The learned Counsel for the petitioner would submit that there was an inter-caste marriage between the petitioner and one Praveen Kumar. This was objected to by the family of the petitioner and there was a threat that was given to the petitioner and her family. Therefore, a complaint was made before the Inspector of Police, Cantonment Police Station at Trichy. The parties were called for enquiry and the parents and relatives of the petitioner undertook, not to interfere with the life of the petitioner.

However, subsequently, the parents and relatives of the petitioner have again started giving threat to the petitioner and the same is being done through the third respondent Police. Therefore, the present writ petition has been filed seeking for Police protection. 3.The learned Government Advocate would submit that this writ petition has been filed by the petitioner, even without making any representation before the second respondent. The learned Government Advocate would further submit that if appropriate representation is made to the second respondent, the same will be considered in accordance with law.

4.The learned Counsel for the petitioner would submit that the representation has already been given to the second respondent on 01.10.2018 by the petitioner seeking for Police protection. 5.In the facts and circumstances of the case, the petitioner is directed to make a fresh representation along with copy of this order, to the second respondent for police protection. 6.In this case, it is seen that the threat is from the parents and relatives of the petitioner. The petitioner is a major and she has married one Praveenkumar and they are living peacefully at Trichy. Once the petitioner has taken a decision to marry Praveenkumar, the parents and the relatives of the petitioner do not have any right to interfere with the life of the petitioner.

The parents and relatives of the petitioner having given an undertaking before the concerned Police at Cantonment Range, not to interfere with the life of the petitioner, cannot continue to exert threat on the petitioner and her family through the third respondent Police. 7.

If the parents and relatives of the petitioner continue to interfere with the life of the petitioner, the second respondent is directed to take appropriate action against them in accordance with law. 8.This writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
