ORDER

This Criminal Original Petition is filed to quash the impugned complaint in S.T.C.No.1196 of 2023 on the file of the learned Judicial Magistrate, Uthamapalayam.

2. The learned counsel for the petitioner would fairly submit that since the trial has already commenced, he would not press for the main prayer to quash the impugned complaint. However, he would submit that the petitioner is aged about 67 years and his appearance before the Trial Court may be dispensed with.

3. Recording the said submission, this Criminal Original Petition is dismissed. However, considering the request of the learned counsel for the petitioner and since the petitioner is aged about 67 years, the personal appearance of the petitioner before the Trial Court is dispensed with unless his appearance is required by the learned Magistrate for the progress of the Trial. Since the trial has already commenced, the learned Magistrate may conclude the trial as expeditiously as possible.
