Prayer :- Criminal Appeal is filed under section 374 of Criminal Procedure code praying this Hon'ble Court against the judgment of conviction dated 07.12.2009 on the Sessions Judge, Tirunelveli District at Tirunelveli made in S.C.No.96 of 2008. ORDER:- Criminal Appeal is coming on for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. D.Vijaya Raghavan For Mr.P.Andiraj, Advocate for the Appellant and of Mr.K.K.RamaKrishnan, Additional Public Prosecutor on behalf of the Respondent, this Court made the following order:

This appeal is pending for more than 10 years. Today, the learned representing counsel for the appellant represents that there are some inconveniences to the learned Senior Counsel and seeks adjournment.

2.Though the case has been listed for several times in the special list of cases pending for more than 10 years giving preference to be disposed of in the usual course or otherwise in the special sitting, it is still pending due to non cooperation of appellant by enjoying the benefit of suspension of sentence given by this Court.

3.Therefore, this court is inclined to revoke the suspension of sentence. Registry is directed to issue necessary warrant to the https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL A(MD). No.429 of 2009 respondent police to secure the accused and the police is directed to secure the accused and retain him in prison to undergo the remaining period of sentence. Registry is directed to list the case in the next special sitting, if it is not disposed of in the usual course.
