ORDER
This Writ Petition has been filed to direct the respondents 1 to 3 to grant permission to conduct Kidamuttu cultural event on 30.01.2025 at Kilamelkudi Village, Manamadurai Taluk, Sivagangai District.
2. The contention of the petitioner is that in order to celebrate Pongal festival, the villagers decided to conduct Kidamuttu on 30.01.2025. There will be no law and order issue during the event. In this regard, the petitioner gave a representation to the respondents to conduct Kidamuttu on 11.12.2024. However, the same was not considered so far. Hence, the present petition has been filed.
3. This Court has not expressed any of its view with regard to the merits of the representation made by the petitioner. It is needless to point out that whenever a representation of this nature is made, the respondents are duty bound to consider the same in one way or the other. Non-consideration of the same would amount to dereliction of ordinary duties of their office and as such, this Court would be justified in 2/5
invoking its powers conferred under Article 226 of the Constitution of India to direct them to consider the petitioner's representation within a stipulated time
4. In view of the limited prayer sought for by the petitioner in the petition without going into the merits of the case there shall be a direction to the respondents to consider the representation of the petitioner, dated 11.12.2024 and pass orders on its merits in accordance with law within a period of two weeks from the date of receipt of a copy of this order.
5. With the above direction the Writ Petition stands disposed of. Consequently, connected miscellaneous petition is closed. 20.01.2025 NCC: Yes/No Index: Yes/No Internet : Yes/No PNM 3/5
