ORDER
This writ petition has been filed challenging the impugned refusal check slip No.RFL/Viralimalai/105/2025 dated 20.08.2025 issued by the 2nd respondent herein, and for a consequential direction to the 2nd respondent herein to register the Sale deed dated 20.08.2025.
2. Heard the learned counsel for the petitioner, learned counsel for the 3rd respondent and the learned Additional Government Pleader for the respondents 1 and 2. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.
3. The grievance of the petitioner is that he intends to purchase the subject property and presented the document for registration dated 20.08.2025. However, the same was refused to be registered on the ground that since the third respondent already filed a writ petition and an 2/6
order was passed therein on 07.07.2025 directing the respondent authorities to register the sale deed of the third respondent within a time frame. Hence, the respondents refused to register the said sale deed.

The learned counsel for the petitioner fairly submits that the third respondent, who intended to purchase the subject property earlier and when his document was refused to be registered on the ground that some objections were raised, he filed a writ petition before this Court and an order came to be passed directing the respondents to register the sale deed. However, now the third respondent is not able to pay the sale consideration and execute the sale deed. Therefore, the petitioner now intends to purchase the property and accordingly presented the document. However, the impugned order came to be passed citing the earlier writ petition.
5. The learned counsel entered appearance on behalf of the third respondent, while conceding the aforesaid facts, would submit that the third respondent is unable to execute the sale deed. He would further submit that the third respondent is ready and willing to give his no 3/6
objection enabling the petitioner to purchase the subject property.
6. The learned Special Government Pleader would submit that in case of no objection to be given by the third respondent, there is no impediment for the official respondents to register the said sale deed.
7. Recording the aforesaid submission, this writ petition is disposed of with the following direction:
On the third respondent giving no objection for the petitioner to get the sale deed registered, the 2nd respondent is directed to register the sale deed presented by the petitioner dated 20.08.2025, if it is otherwise in order. It is made clear that the said exercise shall be carried out, after due notice to the third respondent.
No costs. Consequently connected Miscellaneous Petition is closed. 07.01.2026 NCC : Yes/No Index : Yes/No RR 4/6
