Respondent/Complainant PRAYER: Criminal Appeal is filed under Section 374 of Cr.P.C., to call for the records from the Court below and to set aside the order of conviction dated 16.11.2011 made in S.C.No.340 of 2009 on the file of the Sessions Judge, Mahila Court, Tirunelveli, convicting the appellant for offence under Section 354 of IPC instead of Section 376 r/w 511 of IPC and the appellant was directed to undergo two years rigorous imprisonment and to pay a fine of Rs.10,000/- in default to undergo four months rigorous imprisonment by allowing this appeal and to acquit the appellant herein from all the charges. JUDGMENT

The appellant was convicted for the offence under Section 354 of IPC and sentenced to two years rigorous imprisonment and levied with fine of Rs.10,000/- by the Court below. Challenging the same, this appeal has been filed.

2.When the matter was taken up for hearing, it was submitted that the appellant is no more. Therefore, the proceedings against him will stand abated. This criminal appeal is dismissed accordingly.
