Respondents PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the 1st respondent to transfer the investigation in Crime No.204 of 2019 on the file of the Vachakarapatti P.S., Virudhunagar District preferably to CBCID or to any other honest Investigating Officer from the 5th respondent.

O R D E R

The Criminal Original Petition has been filed to direct the 1st respondent to transfer the investigation in Crime No.204 of 2019 on the file of the Vachakarapatti P.S., Virudhunagar District preferably to CBCID or to any other honest Investigating Officer from the 5th respondent.

2. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police would submit that the respondents have conducted investigation. He would further submit that during the investigation it transpired that the petitioner's son aged about 33 years was addicted alcohol and he had consumed alcohol mixed with poison resulting in his death. The respondents are waiting for Viscera and Chemical Analysis report. He would further submit that 30 witnesses have been examined so far. Crl.O.P.(MD)No. 649 of 2020 be issued to the Additional District Superintendent of Police, Virudhunagar District to monitor the investigation and give instructions before filing final report.

3. Considering the facts and circumstances of the case this Court is of the opinion that there is no slackness in the investigation and thereby there is no need to transfer the investigation. However in the interest of justice direction is issued to the Additional District Superintendent of Police, Virudhunagar District to monitor the investigation conducted by the respondent police.

4. With the above direction, the Criminal Original Petition stands disposed of.
