The present writ petition has been filed by the Secretary of School Management challenging the order of direct payment.

According to the learned counsel appearing for the writ petitioner, as per the orders of the authorities dated 18.07.2024, the educational agency was approved for the period covering from 23.11.2022 to 22.11.2025. After the expiry of the tenure, when the office bearers made an attempt to conduct election, due to interim orders of this Court, election could not be conducted. On the ground that, as on today, there is no approved educational agency. the present impugned order has been passed for making direct payment to the staff concerned. Hence, the present Writ petition.

Per contra, the learned Additional Government Pleader appearing for the official respondents submitted that the tenure of the educational agency has expired and so far no steps have been taken and also the society is not successful in conducting the next election. There is no other alternative, but to pass an order of direct payment to the teaching and non-teaching staff. 2/5
4. Heard both sides and perused the materials available on records.
5. A perusal of the records clearly reveal that the tenure of the petitioner as the educational agency has expired on 22.11.2025. For one reason or other, the election to the society could not be conducted. In such a view of the matter, the order passed by the respondents herein, imposing an order of direct payment cannot be found fault with. Therefore, the order of direct payment shall continue till election is conducted and the elected office bearers take charge.
6. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition is closed.
