Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.S.RAGAVENTHIRE, Advocate for the petitioner and of Mr.R.ANANDHARAJ, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- (Order of the Court was made by T.RAJA. J.) This Miscellaneous Petition has been filed seeking to relax the condition imposed on the petitioner/appellant, by this Court, vide order dated 15.11.2019, in Crl.M.P.(MD)No.8604 of 2019 in Crl.A.(MD) No.468 of 2019.
2.Learned counsel appearing for the petitioner submitted that this Court vide order dated 15.11.2019, in Crl.M.P.(MD)No.8604 of 2019 in Crl.A.(MD)No.468 of 2019, while suspending the sentence imposed on the petitioner, has directed him to report before the learned IV Additional Sessions Judge, Tirunelveli, daily at 10.30 a.m. until further orders. He further submitted that pursuant to the said order, the petitioner has been complying the conditions https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.222 of 2020 promptly from 27.11.2019 onwards, therefore, the conditions imposed by this Court may be relaxed, so that, the petitioner can be able to eke out his livelihood by doing some daily coolie works.
3. At this stage, the learned Additional Public Prosecutor appearing for the respondent, after getting instructions from the respondent, submitted that from 27.11.2019 onwards the petitioner has been complying the conditions regularly without any deviation. 4.Considering the fact that there is no deviation on the part of the petitioner in complying the conditions imposed by this Court, the condition imposed on the petitioner is modified and the petitioner is directed to appear before the learned IV Additional Sessions Judge, Tiruneveli, once in a month i.e., on the first working day of every English Calendar month until further orders. 5.This Miscellaneous Petition is ordered accordingly. sd/- 10/01/2020 / TRUE COPY / / /2020 Sub-Assistant Registrar (C.S.)
