O R D E R

The petitioner challenges the impugned order passed by the first respondent in Pa.Mu.P4/1216/2018 dated 11.01.2023. 2.The petitioner has sought for incorporation of her original name Chinnaponnu in Patta No.575, instead of Ramalakshmi. According to the petitioner, the petitioner was born on 03.04.1959 to her parents Muthu and Seethayammal and further contends that the petitioner is the only legal heir of her parents. The petitioner was called Ramalakshmi also though her original name is Chinnaponnu. When revenue records were mutated, the name Ramalakshmi, wife of Surendiran was included instead of the original name Chinnaponnu, wife of Surendiran. The petitioner therefore, gave a representation to the District Collector on 06.02.2017, seeking change of the name in the patta. The District Collector forwarded the said application of the petitioner to the first respondent to conduct enquiry and to pass orders. Thereafter, the first respondent has passed the impugned order.

3.Heard the learned Counsel for the petitioner and Mr.B.Saravanan, learned Additional Government Pleader appearing for the respondents.

4.Learned Counsel for the petitioner would take me through various documents to substantiate the claim of the petitioner that she was originally named only Chinnaponnu and in support of the said claim, the school records have also been filed. The Aadhar card of the petitioner has also been filed. The date of birth of both Chinnaponnu and Ramalakshmi appears to be 03.04.1959, as per the records submitted by the petitioner. Though, there is no direct document indicating that Chinnaponnu and Ramalakshmi refer to one and the same person, there appears to be no rival claim from any person.

5.In view of the same, I am inclined to set aside the order of the first respondent. The petitioner shall file a sworn affidavit duly notarized, specifically stating the following details, namely, both names referring to one and the same person; date of birth; name of the parents; name of husband and residential address. On such notarized affidavit being furnished by the petitioner, the first respondent shall proceed to effect mutation of the name 3/6

Chinnaponnu in the place of Ramalakshmi. It is however, made clear that in the event of any objection by any person claiming to be the said Ramalakshmi, then the first respondent shall be entitled to recall the modification made. The said exercise shall be completed within a period of four [4] weeks from the date of receipt of a copy of the order.
