ORDER

This Criminal Original Petition has been filed to direct the learned Special Court for Trial of SC/ST Act Cases, Theni to accept the surrender of the petitioner and consider his bail application for release of petitioner on the same day relating to Crime No.818 of 2025 dated 25.12.2025.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

The case of the prosecution is that the defacto complainant, who is the Zonal Secretary of the Tamilpuligal Party, had earlier participated in a protest in November along with others seeking removal of a caste name displayed at the entrance of Kailasanthar Temple, Kailsapatti. It is alleged that, owing to the said incident, the petitioner subsequently threatened the defacto complainant with dire consequences and abused him by using his caste name when the defacto 2/5

complainant and his friend Karnan were present at Kosalai Tea Canteen near Saruthupatti between 10:00 a.m. and 10:45 a.m. Based on these allegations, an FIR has been registered against the petitioner.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the Special Court for Trial of SC/ST Act Cases, Theni, to issue prior notice to the defacto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.818 of 2025 on the file of the 2nd respondent police.
