Plaintiffs Civil Miscellaneous Appeal filed under Order 43 Rule 1(u) of the Civil Procedure Code against the judgment and decree made in A.S.No.83 of 2012, dated 15.4.2014, on the file of I Additional Subordinate Judge, Nagercoil reversing the judgement and decree made in O.S.No.357 of 2010, dated 27.6.2012, on the file of Principal District Munsif Court, Padmanabhapuram. DECREE: This Civil Miscellaneous Appeal is coming on for hearing on this day and upon perusing the grounds of Appeal, the order of the Lower Court and the material papers in this Appeal and upon hearing the arguments of M/s.S.Ramakrishnan, Advocate for the Appellant herein and of Mr.G.Ramanathan, Advocate for the respondents, this Court while dismissing this appeal, doth order and decree as follows:- 1.That the Judgment and decree passed by the I Additional Subordinate Judge, Nagercoil, dated 15.04.2014, made in AS.83 of 2012, be and hereby is confirmed and the civil miscellaneous Appeal is dismissed.

2.The parties be and hereby are directed to appear before the trial Court namely the Principal District Munsif Court, Padmanabhapuram on 19.07.2017.
