JUDGMENT
This Civil Miscellaneous Appeal has been filed by the claimants seeking enhancement of the compensation made in M.C.O.P.No.1031of 2016 on the file of Motor Accidents Claims Tribunal Special District Court, Thanjavur.
2.The deceased was aged about the 20 years at the time of accident. She was a B.B.A. Final year student. The accident took place in the year 2016. Therefore the monthly income fixed by the Tribunal at Rs.6,000/- on notional basis is not correct. The monthly income ought to have fixed at Rs.10,000/-. The Tribunal made 1/3 deduction. It is not correct. Since the deceased was a spinster, 50% deduction has to be made. Therefore, the compensation payable to the claimant can be re worked as follows:- https://hcservices.ecourts.gov.in/hcservices/

The second respondent is directed to pay the said award amount at 7.5% per annum with costs, from the date of petition till the date of realization, within a period of twelve weeks from the date of receipt of a copy of this order, less the amount already deposited, if any. The claimants are permitted to withdraw the entire amount, less the amount as apportioned by the Tribunal, less the amount already withdrawn by them, if any. The award made in M.C.O.P.No.1031 of 2016 dated 14.06.2017 on the file of the Motor Accidents Claims Tribunal Special District Court, Thanjavur is modified accordingly. This Civil Miscellaneous Appeal stands allowed. No costs.
