Respondent/Respondent/ Defendant Prayer : Second Appeal filed under Section 100 of Civil Procedure Code, against the judgment and decree dated 21.04.2004 made in A.S.No.103 of 2002 on the file of the Principal Subordinate Judge, Tiruchirappalli in confirming the judgement and decree dated 15.04.2002 made in O.S.No.5 of 1994 on the file of the 1st Additional District Munsif Court, Tiruchirappalli. For Appellant : Mr.G.Ethirajulu For Respondent : Mrs.Maria Roselin JUDGEMENT The learned Counsel appearing for the appellant seeks leave to withdraw the second appeal. There cannot be any objection to the said request. In fact the appellant's counsel had filed a memo but the same has been returned. Based on the oral submission made by the learned counsel appearing for the appellant, this second appeal is allowed to be withdrawn.

Accordingly, the second appeal is dismissed as withdrawn. Registry is directed to return Ex.A.1 to the learned counsel appearing for the appellant, after the same is duly substituted by a photocopy. The appellant's counsel shall also file a formal application in this regard and the said application shall be allowed without any delay. No costs. Consequently, connected miscellaneous petition is closed.
