DECREE : This Civil Miscellaneous Appeal is coming on for hearing on this day and upon perusing the grounds of Appeal, the order of the Lower Court and the material papers in this Appeal and upon hearing the arguments of Mr.P.PRABHAKARAN, Advocate for Appellant and the respondent is not appeared either in person or through his counsel and this Court doth order and decree as follows :-

1. that the award dated 09.10.2012 made in MCOP.No.1107 of 2006, by the learned Motor Accident claims Tribunal (Second Additional District Court), Thanjavur, be and hereby is confirmed and the Civil Miscellaneous Appeal is dismissed.

2. that the Appellant be and hereby is directed to deposit the entire amount with accrued interest and costs, within a period of eight weeks, from the date of receipt of a copy of this order, if not already deposited.

3. that the claimant be and hereby is permitted to withdraw the entire award amount without filing any formal application before the Tribunal.
